1. ABOUT US
These Terms govern the use of mateartacademy.com and purchases made directly from MATEART. The store is operated by M8 Oil Arts s.r.o., Company ID (IČO) 22365460, registered office at Okružní 331, 417 22 Háj u Duchcova, Czech Republic. Email: matejakjan@gmail.com. Phone: +420 601 574 527.
2. SCOPE AND ACCEPTANCE
By using the website or placing an order, you agree to these Terms and the policies linked from the checkout. Mandatory consumer rights in your country remain unaffected. You must be legally capable of entering into a contract or use the website with the consent of a parent or legal guardian.
3. PRODUCTS AND ORDER PROCESS
We sell digital PDF guides, online courses, and selected physical books. Product descriptions, included materials, language, format, price, and any access conditions are shown on the relevant product page. Before placing an order, you can review and correct the items and information in your checkout.
An order is an offer to buy. The purchase contract is concluded when we send an order confirmation or otherwise accept the order. We may reject or cancel an order where payment is not authorized, information is clearly incorrect, fraud is suspected, or the product is unavailable. If we cancel a paid order, we will refund the affected amount.
4. PRICES, TAXES, AND PAYMENT
Prices and available payment methods are shown at checkout. Applicable taxes are calculated or displayed as required. You agree to provide accurate billing and contact information. Payment is processed by Shopify and the payment provider selected at checkout. We do not receive your complete card details.
5. DIGITAL DELIVERY AND COURSE ACCESS
Digital PDFs are normally delivered by a download link sent to the email address used at checkout. Course access is provided through the relevant account or access instructions. You are responsible for entering a working email address and for keeping account credentials secure. If delivery or access fails, contact matejakjan@gmail.com with your order number so we can restore it.
We may make reasonable technical updates to digital products or the course platform where these do not reduce the purchased content or your mandatory rights. Scheduled maintenance and events outside our reasonable control may temporarily affect access.
6. DIGITAL LICENCE
Unless a product page expressly states otherwise, each purchased PDF, video, or course is licensed to one customer for personal, non-commercial learning. You may download and use it on your own devices and print a reasonable personal copy. You may not share access, upload files, reproduce substantial parts, translate for distribution, resell, sublicense, publish, or otherwise redistribute the materials without our prior written permission.
7. PHYSICAL BOOKS
For physical books purchased directly from MATEART, delivery methods, costs, and estimates are displayed at checkout. Our Delivery and Shipping Policy applies: https://mateartacademy.com/policies/shipping-policy. Risk passes as provided by applicable consumer law. Please inspect the order after delivery and report damage or an incorrect item promptly.
8. EXTERNAL RETAILERS AND AFFILIATE LINKS
Some book recommendations link to Amazon or another independent retailer. If you complete a purchase on an external website, the retailer shown there is the seller and its terms, payment, shipping, and return policies apply. Some external links may be affiliate links, meaning we may receive a commission at no extra cost to you.
9. WITHDRAWAL, RETURNS, AND REFUNDS
Your withdrawal and refund rights depend on the type of product and applicable law. For digital content, an EU consumer's 14-day withdrawal right may end after supply begins only where the required prior express consent and acknowledgement have been obtained. Physical books purchased directly from us may generally be returned by EU consumers within 14 days after receipt, subject to the conditions in our policy. Nothing in these Terms restricts legal remedies for digital content or physical goods that are defective, missing, damaged, incorrect, or not as described.
10. ACCOUNTS AND REVIEWS
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Customer reviews must reflect a genuine experience and must not contain unlawful, abusive, misleading, infringing, or confidential material. We may moderate or remove content where reasonably necessary, but we do not alter the substance of genuine reviews merely because they are critical.
11. ACCEPTABLE USE
You must not use the website to violate law or third-party rights; introduce malicious code; interfere with security or operation; scrape or overload the service; impersonate another person; collect personal data without authority; or distribute spam. We may restrict access where reasonably necessary to protect customers, rights holders, or the service.
12. INTELLECTUAL PROPERTY
The website and its original artwork, text, photographs, videos, PDFs, books, course materials, logos, and designs are owned by or licensed to M8 Oil Arts s.r.o. No rights are transferred except for the limited personal licence expressly granted with a purchase. Third-party names and materials remain the property of their respective owners.
13. ACCURACY AND AVAILABILITY
We take reasonable care to present accurate product information and keep the website available. We may correct genuine errors, update content, or discontinue products. If a material pricing or description error affects an order, we will contact you and offer the lawful options, including cancellation and refund where appropriate.
Educational content explains art methods and reflects the author's experience; individual results vary. Health-related educational content is general information and is not medical advice or a substitute for professional diagnosis or treatment.
14. LIABILITY
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, personal injury caused by negligence, statutory conformity obligations, or any other liability or consumer right that cannot legally be excluded or limited. Subject to those mandatory rights, we are not responsible for losses that were not reasonably foreseeable when the contract was concluded or for business losses arising from a consumer's use of the products.
15. PRIVACY AND THIRD-PARTY SERVICES
Personal data is handled according to our Privacy Policy: https://mateartacademy.com/policies/privacy-policy. Shopify and selected payment, email, digital-delivery, course, analytics, and review providers process data as necessary to operate the store, subject to their roles and applicable privacy law.
16. GOVERNING LAW AND DISPUTES
These Terms are governed by Czech law, without depriving consumers of mandatory protections available in their country of residence. Please contact us first so we can try to resolve a complaint. EU consumers may seek out-of-court dispute resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI): www.coi.cz/informace-o-adr/.
17. CHANGES AND SEVERABILITY
We may update these Terms for legal, technical, or business reasons. The version in effect when an order is placed governs that order unless a mandatory rule requires otherwise. If any provision is unenforceable, the remaining provisions continue to apply.
